Gaming Cloud Services Agreement

THE TERMS AND CONDITIONS SET FORTH BY THE GAMING CLOUD SERVICES AGREEMENT (“GCSA”) ARE SUPPLEMENTARY TERMS AND CONDITIONS TO THOSE OUTLINED BY THE CLOUD SERVICES MASTER AGREEMENT (“CMSA”) AND MUST BE AGREED TO IN ORDER TO ACCESS, USE, OR IN ANY OTHER WAY WHETHER DIRECTLY OR INDIRECTLY, INTERACT WITH THE NORTHEBRIDGE CLOUD MOSAIC GAMING CLOUD (“MOSAIC GAMING CLOUD”) SERVICE.
Submissions of orders for Mosaic Gaming Cloud Services are restricted to persons eighteen (18) years of age or older or the Age of Majority in the country you live in. ANY PERSONAL DETAILS SUBMITTED TO US BY YOU MUST MATCH THIS CRITERION. We do not knowingly store information about people below the Age of Majority AND SHOULD WE DISCOVER OR ARE INFORMED OF AN ACCOUNT IN BREACH OF THE MINIMUM AGE, WE WILL IMMEDIATELY TERMINATE THE ACCOUNT AND DELETE ALL DATA RELATED TO THE ACCOUNT FROM OUR SYSTEMS.
Fraud and Verification Check
When an order is submitted, it is checked using our automated fraud detection system. Orders deemed to be “High Risk” will automatically be rejected but you may open a ticket with Cloud Mosaic Sales to manually place your order at Our discretion. DUE TO THE NATURE OF GAME HOSTING, ALL NEW CLIENTS ARE REQUIRED TO SUBMIT A COPY OF THEIR VALID GOVERNMENT ISSUED PHOTO I.D. WITH THEIR PHOTO, NAME, DATE OF BIRTH, AND ADDRESS VISIBLE. ALL OTHER INFORMATION MAY BE REDACTED. THIS PHOTO I.D. SHOULD MATCH THE CARDHOLDER. Once your identification has been verified, We will provision Your Services.
When You register for a Cloud Mosaic Gaming Cloud Service You may only render payment via Square or Stripe. NET30 INVOICE PAYMENTS ARE NOT AVAILABLE TO CLOUD MOSAIC GAMING CLOUD SERVICES EVEN IF THE CLIENT IS ALREADY RECEIVING NET30 INVOICES FROM NORTHEBRIDGE FOR OTHER CLOUD MOSAIC SERVICES. When you first create an account with the Cloud Mosaic Gaming Cloud Service, you will be charged for both the first and second month of Service.
Trial & Discounts Addendum
NORTHEBRIDGE CLOUD MOSAIC GAMING CLOUD SERVICE DOES NOT INCLUDE A 24-HOUR TRIAL FOR ANY OFFERINGS. ANY DISCOUNTS OR DEALS APPLICABLE TO CLOUD MOSAIC BY NORTHEBRIDGE ARE NOT APPLICABLE TO NORTHEBRIDGE CLOUD MOSAIC GAMING CLOUD UNLESS OTHERWISE EXPLICITLY STATED.
We display all currencies in United States Dollars (USD). All transactions will be processed at the then-current exchange rate between Your local currency and the United States Dollar.
NortheBridge Cloud Mosaic Gaming Cloud OFFERS NO REFUNDS FOR SERVICES RENDERED UPON THE START OF THE PROVISIONING OF AN ORDER. AN ORDER SHALL BE CONSIDERED PROVISIONING UPON COMPLETING FRAUD CHECK. YOU MAY CONTACT NORTHEBRIDGE ACCOUNT SERVICES ANYTIME BEFORE PROVISIONING TO CANCEL AN ORDER FOR A FULL REFUND.
Management and Remote Hands
NortheBridge Cloud Mosaic Gaming Cloud maintains the same level of management as the NortheBridge Cloud Mosaic’s Mosaic One: “semi-management.” We will maintain the underlying hardware, hypervisor, operating system, and software compatibility with our systems. You will be responsible to ensure your Gaming Cloud Server continues to function to your specifications. IF YOU NEED US TO INTERVENE IN YOUR GAMING CONFIGURATION, YOU WILL BE CHARGED A “REMOTE HANDS” FEE OF $5 USD PER AN INCIDENT WHICH MAY BE WAIVED AT THE DISCRETION OF NORTHEBRIDGE.
Subdomains & IP Addresses
Upon provisioning of your Cloud Gaming Server, You will be assigned a subdomain and an IP address for which you may connect to it and manage it. NortheBridge Cloud Mosaic Gaming Cloud offers no limitation in using your own domain EXCEPT IF THE GAME WHICH THE SERVER INSTANCE IS RUNNING FOR IS LIMITED TO USING A SINGLE SUBDOMAIN.
When a Service is terminated whether intentionally or due to a breach of the CSMA or GCSA, the subdomain and IP address are automatically released.
Data Retention, Security, and Backup
NortheBridge Cloud Mosaic Gaming Cloud Service is ONLY BACKED UP IF YOU SELECT THE RAPID SERVICE RECOVERY OPTION OR ADD IT TO YOUR SERVICE AT A LATER DATE. We strongly recommend that You maintain a copy of Your own server backups. IF YOU SELECT THE RAPID SERVICE RECOVERY OPTION, WE RETAIN 24 HOURS WORTH OF BACKUPS FOR RAPID RESTORE IN THE EVENT OF A SERVICE OUTAGE OR IF YOU NEED THE DATA RESTORED TO YOUR GAME INSTANCE.
Slots & Connections
At checkout, We offer You the option for the number of Slots or connections You would like to have available on Your game instance. This is also known as player slots, game slots, or other similar terminology. This, however, does not mean nor guarantee the number of connections can be made to the instance.
Dedicated & Dynamic CPU
Each Gaming Instance is given dedicated resources specified to run the game server adequately at the level purchased. The Mosaic Hypervisor Service powered by Microsoft Hyper-V is always checking the Node (the dedicated hardware for which the instance runs on) for more available resources and will dynamically allocate more resources to instances that require it as needed. This does not guarantee you will receive anything beyond your base allocation of dedicated CPU.
Dedicated & Dynamic RAM
If You were given an option to choose the amount of RAM available to your Instance at checkout this does not mean that the entire amount of RAM may be accessible. The instance’s operating system and certain background daemons may result in less total RAM being accessible. The Cloud Mosaic Hypervisor powered by Microsoft Hyper-V constantly queries the Node for available resources and will dynamically assign more RAM as needed to instances as needed. This does not guarantee more RAM above your base allocation.
Acceptable Use Policy & Circumvention of Resource Limits
Attempts to circumvent resource limits or any breach of the Acceptable Use Policy as outlined in the Cloud Services Acceptable Use Policy may result in immediate termination without refund. The Cloud Services Acceptable Use Policy shall apply to the use of this Service.
The NortheBridge Cloud Mosaic Gaming Cloud includes DDoS mitigation. However, the level and sophistication of an attack may still affect other clients on our network. We do not guarantee that You will not be affected by a DDoS attack and We do not provide credits or refunds if You are affected by a DDoS attack. You agree to indemnify and hold us harmless of any loss or harm that you or a third-party occur whether financial, non-financial or otherwise, as a result of a DDOS attack, and therefore we will not be held liable for any result of such occurrences.
You understand that We may have to take extreme actions to ensure the stability of Our network including but not limited to null routing Your Services.
Limitations of Liability, Dispute Resolution, Force Majure, Disclaimer, and Dispute Resolution
The Limitations of Liability, Dispute Resolution, Force Maure, Disclaimer, Dispute Resolution, and all related sections and subsections within the Cloud Service Master Agreement shall apply.
